Hon Touma Njie Maintains Seat but Loses Injunction Against Kebba Jallow’s PPP Leadership

Justice C.A Kwabeng delivered a judgement on Thursday 5th December 2024 against Hon Fatoumata Njie of Banjul South, commonly known as Touma Njie after she filed an application for various injunctions against the Peoples Progressive Party (PPP) back on 16th June 2021.
Amongst other issues, Hon Njie challenged the validity of the election where Kebba Jallow was elected as leader of the PPP during a congress held on 26th and 27th February 2021 claiming that she was absent during the conduct of votes.
A Kerr Fatou report highlighted that, "...Touma Njie is reported to have — walked out at the PPP congress in Brikama on grounds that some of her supporters were barred from entering to vote for her”.
At the judgement, the Court Judgement highlighted that, the applicant (Hon Njie) "was given fair chance to contest the election" adding that , she left the election grounds on her own accord and that, no one could have retained her to witness the voting process which was done by a show of hands which is in line with the 1997 constitution.
Judge Kwabeng held that there is no evidence to prove that the said election was fraudulent because Hon Njie failed to provide evidence to back this claim. The Judge maintained that, Kebba Jallow's position as the Leader of the PPP remained in tact.
Although she has failed in her application for multiple injunctions, Hon Njie succeeded in maintaining her seat as a National Assembly Member for Banjul South given the Court’s ruling in her favour on this particular issue.
At the Judgement, respondent Kebba Jallow was present while applicant Hon Fatoumata Njie was absent when judgement was being delivered. Lawyer LK Mboge for first respondent was also absent.
Justice Kwabeng advised the two parties to maintain a harmonious relationship. The Judgement was delivered at Kanifing High Court Annex next to the Kanifing Municipal Council at Westfield.
